The following terms and conditions apply to the "Hessentag" competition, which will be held in June 2025 via the Bubble Pop brand's Instagram channel. By participating in the competition, participants accept these terms and conditions.

1. Organizer

The organizer of the competition is:

POWAFOOD GmbH, Schultheiß-Bilger-Str. 9, 61118 Bad Vilbel

(hereinafter referred to as “POWAFOOD”).

Competition period: June 13, 2025 to June 23, 2025 at 11:59 PM

2. Conditions of participation

2.1 Only natural persons aged 18 and over with permanent residence in Germany are eligible to participate. Minors may only participate with the express consent of their legal guardians. This consent must be provided to POWAFOOD upon request.

2.2 Participation is free of charge and only possible during the above-mentioned participation period via the *Bubble Pop* Instagram channel.

2.3 Participation takes place via Instagram and includes the following steps:

2. Share – Post a story of your Bubble Pop and tag us

3. Be lucky – land in the draw and with a little luck win!

Note: Posting a story with a Bubble Pop product is not a requirement for purchasing the product. Participation is possible regardless of purchase.

2.4 Five winners will be randomly drawn from all valid participants, each of whom will receive one of three possible prizes:

- 1x Apple AirPods (4th generation)

- 1x smartphone instant photo printer

- 3x voucher of your choice worth 50€

2.5 The winners will be notified via direct message (DM) on Instagram. The prize will be shipped to the address provided by the winner within approximately 14 days at POWAFOOD's expense (no deadline).

2.6 If a person selected does not respond within 7 days of notification, the prize will be awarded to a new person. The original claim will be forfeited.

2.7 The entire transaction is handled by POWAFOOD.

3. Profit

3.1 The winners will be randomly selected by POWAFOOD.

3.2 Cash payment, exchange or transfer of the prize is excluded.

3.3 If a prize is not available, POWAFOOD reserves the right to provide a substitute of equivalent value.

4. Exclusion from the competition

4.1 POWAFOOD reserves the right to exclude participants from the competition in the event of violations of these terms and conditions. This applies in particular to manipulation, false statements, the use of fake profiles, or other unfair means.

5. Early termination

5.1 POWAFOOD reserves the right to terminate or modify the competition prematurely at any time if unforeseeable events occur that affect its proper execution (e.g., technical problems, legal reasons, manipulation by third parties).

6. Data protection

6.1 POWAFOOD processes personal data exclusively for the purpose of administering the competition in accordance with applicable data protection laws.

6.2 The data will not be passed on to third parties unless this is necessary to process the prize delivery (e.g. shipping service providers).

6.3 As part of the competition, POWAFOOD processes the following personal data in particular:

- Instagram username (via story mention),

- if necessary, name and address of the winners, if necessary to send the prize.

6.4 The data will be used exclusively for the duration of the competition and will be deleted no later than four weeks after the end of the competition, unless statutory retention periods prevent this.

7. Liability

7.1 Without prejudice to any other statutory requirements for claims, the following exclusions and limitations of liability shall apply to POWAFOOD's liability for damages:

7.2 POWAFOOD shall be liable without limitation if the cause of damage is based on intent or gross negligence.

7.3 Furthermore, liability arises for breaches of essential obligations caused by slight negligence, the breach of which jeopardizes the fulfillment of the contractual obligations, or for breaches of obligations whose fulfillment is essential for the proper conduct of the competition and on whose compliance the participants regularly rely. In such cases, POWAFOOD's scope of liability is limited to foreseeable damage.

7.4 POWAFOOD shall not be liable for minor negligent breaches of obligations other than those mentioned above.

7.5 The above limitations (8.2 to 8.4) shall not apply in the event of injury to life, body or health.

7.6 The exclusion or limitation of liability of POWAFOOD also applies to the personal liability of representatives and vicarious agents of POWAFOOD and their employees.

7.7 In the event of a defective prize, the respective winner must notify POWAFOOD in writing (e.g., by email) within 14 days of receiving the prize and report the defect. After the expiration of the aforementioned deadline, claims for obvious defects are no longer possible.

8. Instagram notice

8.1 This competition has no connection with Instagram and is neither sponsored, supported nor organized by Instagram.

8.2 No claims arise against Instagram. POWAFOOD is the sole contact for all questions.

9. Final provisions

9.1 Legal recourse is excluded.

9.2 The law of the Federal Republic of Germany shall apply, excluding international private law and the UN Convention on Contracts for the International Sale of Goods incorporated into German law.

9.3 Should individual provisions of these Conditions of Participation be or become invalid or void in whole or in part, this shall not affect the validity of the remaining provisions of the Conditions of Participation.
